Welcome to Homessence Group (HE Group). This website and the services offered herein are owned and operated by HE Group, headquartered in Auckland, New Zealand. By accessing our website, engaging our art-asset advisory services, or purchasing cultural assets through our platform, you unconditionally agree to be bound by these Terms & Conditions.

1. Scope of Services & Institutional Advisory Disclaimer
  •  Art-Asset Advisory: HE Group provides art-asset advisory, artist management, curatorial intelligence, and private sale coordination.
  • No Financial or Investment Advice: HE Group is an art-asset advisory and artist management venture. We are not financial advisors, and the information provided on this website or in our investment-focused market intelligence collateral does not constitute financial, investment, tax, or legal advice. Art markets carry inherent volatility and risks. Past performance, historical auction tracking, and early-market valuations are no guarantee of future value appreciation or capital preservation. Patrons assume all marketplace risks.
2. Cross-Border Anti-Money Laundering (AML) & Know Your Customer (KYC) Compliance
  • Identity Verification Mandate: In compliance with the New Zealand Anti- Money Laundering and Countering Financing of Terrorism (AML/CFT) Act and equivalent international statutes (including EU/UK AML Directives and US Bank Secrecy Act frameworks), HE Group enforces strict identity verification protocols.
  • Verification Thresholds: Prior to the finalisation of any private sale, commission, or transaction exceeding legal statutory thresholds, buyers must submit authenticated government-issued identification, proof of address, and, where requested, corporate registration or corporate verification documents.
  • Transaction Termination: HE Group reserves the absolute right to unilaterally suspend, halt, or cancel any transaction, asset transfer, or negotiation if a client fails to provide adequate KYC data or if a background check flags potential regulatory compliance risks. HE Group holds zero liability for transaction delays or financial losses resulting from AML compliance holds.
3. Consignment, Commissions, and Artists’ Rights
  • Bespoke Commissions: For tailored commissions managed by HE Group involving our roster of academically trained artists (including talent based in India and globally), structural milestones, initial deposits, and delivery schedules will be governed by a separate, binding Bespoke Commission Agreement. These website terms serve as a baseline framework to that agreement.
  • Intellectual Property Retention: Unless expressly transferred via written contract, the intellectual property rights, copyright, and reproduction rights of all original artworks remain exclusively with the creating artist. The purchaser acquires the physical asset but does not acquire copyright or commercial reproduction privileges.
4. Auction Page Mechanics & Third-Party Limitations
  • Indirect Hosting Framework: The HE Group website features a dedicated auction showcase page. HE Group rarely hosts auctions natively on this digital domain.
  • Third-Party Redirection: Most auction events are facilitated via integration or digital redirection to certified third-party global auction platforms.
  •  Liability Exclusions: When navigating to external bidding platforms, you acknowledge that you are bound by that specific platform’s operational rules. HE Group explicitly disclaims all liability for third-party bidding software glitches, processing errors, bid placement failures, security breaches, or disputes arising between bidders and external platforms.
5. Provenance and Authenticity Guarantees
  • Verification Standards: HE Group prioritises market intelligence and verified provenance. We conduct rigorous curatorial due diligence to authenticate the pedigree of every high-value cultural asset passing through our venture.
  • Recourse Limitations: In the highly exceptional event that the provenance or authenticity of an asset acquired through HE Group is formally disputed by a recognised independent global authority, claims must be brought to HE Group within twenty-four (24) months of the purchase date. Any financial recourse, if deemed legally valid, will be strictly capped at the original purchase price paid directly to HE Group, excluding external transport, storage, or third-party advisory fees.
6. Governing Law & Global Dispute Resolution
  • Primary Jurisdiction: These Terms & Conditions, and all operational interactions with HE Group, are governed by and construed in accordance with the laws of New Zealand.
  •  Dispute Escalation: Any dispute, difference, or claim arising out of or in connection with our services must first be submitted to private, confidential mediation in Auckland, New Zealand. If mediation fails to resolve the matter within sixty (60) days, the dispute shall be definitively settled by the courts of New Zealand, or, at the sole election of HE Group, via binding international arbitration under NZIAC rules.
7. Copyright & Intellectual Property (IP) Notice

1. Proprietary Digital Assets
All digital content featured across this platform – including but not limited to the HE Group brand name, corporate logos, textual market intelligence, curatorial reports, proprietary artist dossiers, website UI layout design, graphics, photographic reproductions of artworks, and video material – is the exclusive intellectual property
of HE Group or its licensed content creators, protected by New Zealand and international copyright, trademark, and intellectual property laws.
2. Digital Use Restrictions
Visitors are granted a limited, non-transferable, revocable license to access and view our digital platform for private, non-commercial acquisition research. You are strictly
prohibited from scraping, downloading, modifying, replicating, distributing, or republishing any proprietary market intelligence, curatorial assets, or artwork photography without explicit, prior written authorisation signed by an executive director of HE Group.

8. Copyright & Intellectual Property (IP) Notice

1. Ownership of Proprietary Assets
The digital infrastructure of this website, including its visual interface layout, coding architecture, structural design, text copy, specialized market intelligence matrices,
curatorial logs, artist documentation, corporate logos, and the trademarked brand name Homessence Group, constitutes the exclusive proprietary intellectual
property of Homessence Group, protected under New Zealand and international copyright treaties.
2. Original Artwork and Artistic Copyright
The physical ownership of a high-value original artwork or custom commissioned piece purchased through Homessence Group transfers to the elite patron strictly upon transaction finalisation and delivery verification. However, the intellectual property rights, copyright, reproduction privileges, and commercial exploitation rights
remain exclusively retained by the creating artist under international copyright acts, unless an express, written intellectual property assignment contract is signed by both
Homessence Group, the artist, and the buyer. Unauthorised reproduction, commercial printing, or digital replication of any curated art asset is strictly criminalised.
